The Chapter 7 Bankruptcy Means Test

As of October 17, 2005, all bankruptcy filers are required to apply a means test to determine whether they can eliminate their consumer debt through Chapter 7 bankruptcy, or should reorganize their total debts through a supervised Chapter 13 debt reorganization plan. Here is the basic means test that will apply. We do not recommend that you use this means test posted on this site as the final determining factor in filing. Only a qualified bankruptcy and debt relief attorney can determine whether you qualify for Chapter 7.

Means Test

1. Subtract your monthly income from your monthly expenses = $n

2. Multiply $n x 60 = $result

3. If $result is greater than $10,000, or more than 25% of your debt = Chapter 13 debt reorganization plan

If $result is less than $6,000, or less than 25% of your debt =

Chapter 7 consumer debt elimination.
